Privacy Policy for RehearScore™

This privacy policy (this “Privacy Policy”) sets forth how MTI ENTERPRISES INC. d/b/a MUSIC THEATRE INTERNATIONAL (“MTI”) collects, uses, stores and protects the information of the individuals (each, a “User”) who access MTI’s mobile application named RehearScore™ (the “App”).

This Privacy Policy applies solely to the App and does not apply to any other websites, services and/or applications. By accessing the App, each User accepts and consents to the terms and conditions set forth in this Privacy Policy and to have such User's information collected, maintained, transferred and/or processed in and to the United States of America and other countries and territories. MTI reserves the right to modify this Privacy Policy, in whole or in part, at any time. Any such modification will be effective immediately upon MTI posting the modified Privacy Policy, and each User's continued access of the App thereafter will constitute such User's acceptance of and consent to such modifications.

How Users Access RehearScore™

The App is designed to protect each User's privacy and to collect as little information from each User as possible. While the App is available for public download, access to content on the App is restricted. To unlock specific content on the App, a producing organization (a "Customer") must first license a show from MTI that explicitly includes access to the App. After licensing a show from MTI and purchasing access to the App for such show, MTI will immediately provide the Customer with three (3) unique codes providing different access levels (each an "Access Code") which the Customer can distribute to provide a User with access to certain content relating to such show. For the avoidance of doubt, a User may access the App through a Customer without the User being a Customer.

MTI's Handling of User Information:

MTI maintains a record of which Customer's MTI account is associated with each Access Code and stores such information on servers maintained for MTI to verify access to the App.
MTI stores certain Musical Instrument Digital Interface (.midi) files on each User's device until the Customer's license expires or terminates to enable the App's musical accompaniment features during the licensed production period.

Information Not Collected:

The App does not allow any User to create a personal account or provide such User's name, email address, phone number, mailing address and/or other personally identifiable information and, accordingly, the App does not collect any such personally identifiable information;
The App does not utilize cookies or similar tracking technologies;
The App does not collect any log data, device data, usage data and/or background metrics; and
The App does not share information with third parties.

Data Sharing and Disclosure:

MTI does not sell, trade and/or otherwise transfer any User information to third parties except as described below and as necessary to provide service through the App. MTI may comply with judicial requests for Access Code records when MTI determines in MTI's sole discretion that such disclosure is necessary or appropriate. Additionally, MTI may share Access Code records with third parties when MTI determines in MTI's sole discretion that such disclosure is deemed necessary to protect MTI's interests and/or property and/or to prevent fraud and/or unlawful activity perpetrated through and/or in connection with the App.

Children's Privacy

The App is not designed to collect personal information from any User, including, without limitation, children under the age of thirteen (13), and MTI does not knowingly collect, use and/or disclose personal information from children under the age of thirteen (13). If anyone believes that a child under the age of thirteen (13) has submitted personal information to MTI in connection with the App, such person should contact MTI at the email address provided below and MTI will delete such information.

User Privacy Rights

Certain jurisdictions provide their residents with rights regarding such residents' personal information, including, without limitation, the rights to access, correct and/or delete such personal information. Because the App does not collect personal information from any User, MTI does not maintain any personal information about any User to access, correct, and/or delete. If a User wishes to submit a request regarding such User's personal information, such User may contact MTI at the email address provided below.
